Terms of Service

These Terms of Service (“Terms”) constitute a legally binding agreement between Involtz UK Ltd, a company incorporated in England and Wales (“Company”, “we”, “us”, “our”), and any individual or entity who accesses, uses, or rents portable charging devices from the Company (“User”, “you”, “your”). By accessing or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms.

1. Definitions

For the purposes of these Terms:

1.1 “Company” means Involtz UK Ltd, its affiliates, directors, officers, employees, and authorised agents.

1.2 “Services” means the rental, provision, maintenance, and related functionalities of portable charging devices (“Power Banks”) via kiosks, stations, software, or other mechanisms controlled by the Company.

1.3 “User” means any person who rents, uses, or attempts to use any Power Bank or engages with the Services.

1.4 “Power Bank” means any portable charging device owned or provided by the Company for temporary rental.

1.5 “Kiosk” / “Station” means any authorised location, stand, or unit owned or operated by or on behalf of the Company from which Power Banks may be rented or returned.

1.6 “Fee Policy” refers to all price lists, fees, schedules, and charges displayed within the Company’s mobile application, website, kiosk interface, or any other communication channel.

2. Eligibility and User Obligations

2.1 Users must be at least 16 years of age to access or use the Services.

2.2 By using the Services, the User warrants that:

  • They possess the legal capacity to enter into a binding agreement.

  • All information provided to the Company is accurate, complete, and current.

  • They will comply with all applicable laws, regulations, and these Terms.

2.3 Users assume full responsibility for the Power Bank and any associated equipment from the moment it is released from the Kiosk until it is properly returned and recorded as returned by the system.

3. Rental Process

3.1 A rental commences when a Power Bank is successfully removed from a Kiosk and terminates only when the Power Bank is securely reinserted into an authorised Kiosk and electronically registered as returned.

3.2 The User acknowledges that improper insertion, failed return attempts, or returning to unauthorised locations shall not constitute a valid return. The User remains liable for ongoing rental fees until a proper return is completed.

3.3 The Company may implement temporary holds or pre-authorisations on the User’s payment method as security for potential fees.

4. Fees, Charges, and Payments

4.1 All rental charges, late fees, loss fees, damage charges, and other costs are governed by the Fee Policy. By renting a Power Bank, the User irrevocably authorises the Company to charge all applicable fees to the payment method provided.

4.2 Late Fees

If the User fails to return the Power Bank within the designated rental period, additional charges shall apply as specified in the Fee Policy.

4.3 Loss, Theft, or Damage

The User shall be fully liable for:

  • Loss or non-return of the Power Bank.

  • Theft of the Power Bank while in their possession.

  • Deliberate or negligent damage.

The Company reserves the right to charge the full replacement value.

4.4 Payment Authorisation

The User expressly authorises the Company to:

  • Charge all outstanding amounts automatically.

  • Reattempt failed charges.

  • Employ third-party agencies for recovery if payments remain unpaid.

5. User Duties and Prohibited Conduct

5.1 The User must:

  • Use the Power Bank solely for charging portable electronic devices.

  • Exercise reasonable care to prevent loss, theft, or damage.

  • Return the Power Bank in the same condition as received, except for fair wear and tear.

5.2 The User must NOT:

  • Tamper with, dismantle, modify, or damage any Power Bank or Kiosk.

  • Use fraudulent payment information.

  • Sell, transfer, or attempt to commercially exploit the Power Bank.

  • Use the Services for unlawful, harmful, or abusive purposes.

Any breach of this clause may result in immediate suspension, liability for damages, and possible legal action.

6. Service Availability and Company Rights

6.1 The Company does not guarantee continuous, uninterrupted, or error-free access to the Services.

6.2 The Company reserves the right to:

  • Remove or relocate Kiosks.

  • Disable or retrieve Power Banks at its discretion.

  • Suspend or terminate a User’s access for breach of these Terms.

  • Modify pricing or policies at any time.

7. Liability, Risk, and Disclaimers

7.1 The User acknowledges that the Power Banks are provided “as is” and “as available”.

7.2 To the maximum extent permitted by UK law:

  • The Company disclaims all warranties, express or implied, including fitness for a particular purpose, durability, and compatibility with specific devices.

  • The Company shall not be liable for:

    • Damage to User devices caused by use of the Power Bank.

    • Loss of data.

    • Personal injury or property damage arising from misuse.

    • Indirect, incidental, or consequential damages.

7.3 Users assume all risks associated with:

  • Use of the Power Bank.

  • Environmental or electrical conditions affecting performance.

  • Misuse by themselves or third parties to whom they give access.

8. Indemnification

The User shall indemnify and hold harmless Involtz UK Ltd from any claims, liabilities, damages, losses, or expenses arising from:

  • Breach of these Terms.

  • Misuse of the Services.

  • Loss or damage to property or devices.

Third-party claims arising from User conduct.

9. Data Protection & Privacy

The Company shall process all User personal data in accordance with:

  • The UK General Data Protection Regulation (UK GDPR)

  • The Data Protection Act 2018

  • The Company’s Privacy Policy

By using the Services, the User consents to such processing.

10. Dispute Resolution

10.1 Any dispute shall first be attempted to be resolved informally by contacting the Company.

10.2 If informal resolution fails, disputes shall be referred to binding arbitration in the United Kingdom under the rules of the Chartered Institute of Arbitrators (CIArb), unless otherwise required by mandatory consumer law.

10.3 The governing law of these Terms is the laws of England and Wales.

11. Amendments

The Company may modify these Terms at any time. Updated Terms will be published via the Company’s website or mobile application. Continued use after such changes constitutes acceptance.
